It still may “work” but the simple fact that it still can be used to even try to damage or “steal” others, proves that it is flawed. I’m not talking just about samsung and apple but about all the ideas that are stolen by big corporations simply because they have more money to spend on lawyers.

Nullifying “patent trolls” and encouraging innovation will indeed be the key markers in determining the future success of the US patent system. Given its market size and the important role it plays in fostering technology innovation, if the US authorities get it wrong the impact may well be felt around the world.
